Tech innovation tested in regulatory sandbox

Jake Morabito, director of communication for the Technology Task Force of the American Legislative Exchange Council (ALEC), explains that the sandbox approach provides a temporary exemption from regulation that helps innovators apply new technologies like AI, blockchain, and autonomous technology without being licensed or regulated by the state. The regulatory sandbox also allows state legislators to better understand how regulation may be stifling innovation and pave the way for regulatory reform that undermines harmful regulation. North Carolina recently launched a fintech regulatory sandbox website in December 2022, following legislation enacted in October 2021 that established an NC Innovation Council to oversee the sandbox. The sandbox may exempt certain requirements for a product or service and applicants can receive a waiver to test their product or service for up to 24 months. The launch of the sandbox website is a milestone, and Charlotte City Councilman and Carolina Fintech Hub leader Tariq Bokhari said the state innovation council will ultimately focus on a broader type of sandbox called a universal sandbox that covers all industries, not just fintech. Morabito added that the sandbox approach is a preferred approach for businesses to access a tool for making the state economically competitive and attractive to startups.

The End of TikTok?

The Richmond Journal of Law and Technology reports that the popular video-sharing app TikTok is facing bipartisan backlash from federal lawmakers and state governors who fear that it provides unrestricted access to user data to the Chinese government, as it is owned by Beijing-based Byte Dance Ltd. While a TikTok representative assures that the app does not share user data with the Chinese government, lawmakers are concerned that Chinese authorities may require Byte Dance to hand over data collected by the app. As a result, TikTok has already been banned from state-issued devices in approximately two dozen states, and the federal government is now considering prohibiting it entirely. Recently a group of bipartisan senators introduced a bill aimed at dealing with technology companies based in adversary countries, which would create a new government process for reviewing potential risks inherent in the use of foreign technology and blocking technology found dangerous.

The breach compromised data such as social security numbers, health insurance information, and medical history of patients. HPMB was required to adhere to advanced data security practices under HIPAA law, but the law firm’s security failure violated state law.
